Terms & Conditions
Last updated: September 25, 2026
These Terms & Conditions (the “Terms”) govern your use of the Merozella Bistro website and the reservation requests and enquiries you send us through it. The website is operated by (“Merozella Bistro”, “we”, “us” or “our”), a company incorporated in the Province of British Columbia, Canada.
Please read these Terms carefully. They explain what you can expect from us and what we expect from you when you use our website.
1. About us
Merozella Bistro is an Italian restaurant located in Kelowna, British Columbia. The website is provided to give information about our restaurant, our menu, our team and our location, and to allow you to send us reservation requests and enquiries. Our contact details:
British Columbia incorporation number: BC1493728
E-mail: info@merozellabistro.com
Telephone: +1 604 738 5296
2. Acceptance of these Terms
By accessing or using this website you agree to these Terms. If you do not agree with them, please do not use the website. These Terms apply together with our Privacy Policy and our Cookie Policy, which explain how we handle personal information and which technologies the website uses.
If you use the website on behalf of a company or another organisation, for example to plan a business dinner, you confirm that you are authorised to accept these Terms on its behalf.
3. Using our website
You may use the website for your personal, non-commercial purposes, such as learning about our restaurant and contacting us. You agree not to:
- use the website in any way that breaks the law or infringes the rights of others;
- send false, misleading, offensive, threatening or defamatory information, or make reservation requests in another person’s name without their permission;
- send unsolicited advertising or bulk messages to our contact details;
- attempt to gain unauthorised access to the website, the server on which it is stored or any connected system, or interfere with the website’s operation, for example by introducing malicious code or overloading it with automated requests;
- copy, scrape or reuse the website’s content for commercial purposes without our written permission.
We may restrict access to the website or ignore messages if we reasonably believe these Terms have been breached.
4. Reservation requests and enquiries
You can ask for a table using the reservation form on our contact page, by e-mail or by telephone. The form opens your own e-mail application with a pre-filled message; the request is sent only when you send that e-mail.
- A reservation request is not a confirmed booking. A reservation is confirmed only when our team replies to you by e-mail or telephone.
- We try to accommodate every request, but availability is limited. We may decline a request or suggest another date or time.
- Please give us accurate contact details so that we can confirm your reservation or contact you if something changes.
- If your plans change, please let us know as early as possible so that we can offer the table to other guests.
- If you are running late, please call us. We will do our best to hold your table, but we cannot always guarantee it during busy service.
Our opening hours and address are shown on our contact page. We may change our hours, for example on public holidays, and will try to inform guests with confirmed reservations of any change that affects them.
5. Private dining and events
Requests for private dining, group reservations and events are subject to availability and to a separate written confirmation from us. That confirmation will describe the menu, the number of guests, prices, any deposit and the applicable cancellation terms. If there is a conflict between these Terms and a written event confirmation, the event confirmation applies to that event.
7. Dietary information and allergens
Information about dietary options and ingredients on the website is general. Recipes and suppliers can change, and our kitchen handles common allergens such as gluten, dairy, eggs, nuts, fish and shellfish. Although we follow careful kitchen practices to limit cross-contact, we cannot guarantee that any dish is completely free of a particular ingredient.
If you have a food allergy or dietary requirement, please tell us when you make your reservation and inform your server before ordering, so that our team can guide you through suitable choices.
8. Intellectual property
The website and its content, including text, photographs, graphics, the Merozella Bistro name and logo, the page design and the underlying code, are owned by us or used under licence and are protected by Canadian and international copyright, trademark and other intellectual property laws.
You may view the website and print or save individual pages for your own personal, non-commercial use. You must not reproduce, distribute, modify, publicly display or create derivative works from any part of the website, or use our name or logo, without our prior written permission.
9. Your messages and submissions
You are responsible for the information you send us. Please make sure that it is accurate and that you have the right to share any information about other people, for example the guests you are booking for. Do not send us confidential, sensitive or unlawful content.
If you send us feedback or suggestions, you agree that we may use them to improve our restaurant and our services without any obligation to you. We handle all personal information in your messages in accordance with our Privacy Policy.
10. Third-party services
The website does not contain advertising, social media plug-ins or embedded content from other websites. When you use the reservation form, your message is prepared and sent by your own e-mail application or service, which is provided by a third party under its own terms. We are not responsible for the availability, security or practices of services that we do not control.
If we add links to other websites in the future, those links will be provided for convenience only, and we will not be responsible for the content of those websites.
11. Availability and changes to the website
We aim to keep the website available at all times, but we do not guarantee that it will be uninterrupted, timely or free of errors. We may suspend, withdraw or change all or part of the website, for example for maintenance or updates, without notice. We will not be liable if the website is unavailable at any time or for any period.
12. Disclaimer
The website and its content are provided on an “as is” and “as available” basis for general information only. To the fullest extent permitted by law, we make no representations or warranties of any kind, express or implied, about the website, including warranties of accuracy, completeness, fitness for a particular purpose or non-infringement. Nothing on the website constitutes professional advice.
13. Limitation of liability
To the fullest extent permitted by the laws of British Columbia and Canada, we will not be liable for any indirect, incidental, special, consequential or punitive loss or damage, or for any loss of data, profit, revenue, business or goodwill, arising out of or in connection with your use of, or inability to use, the website or any content on it.
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or any rights you have as a consumer under applicable law that cannot be excluded or limited by contract.
14. Indemnity
You agree to indemnify and hold harmless Merozella Bistro, its directors, employees and agents from any claims, losses, damages and reasonable legal costs arising from your breach of these Terms or your misuse of the website, to the extent permitted by law.
15. Privacy and cookies
We respect your privacy. Our Privacy Policy explains what personal information we collect, why we collect it and what rights you have. Our Cookie Policy explains that the website currently does not use cookies or similar tracking technologies.
16. Changes to these Terms
We may revise these Terms from time to time, for example to reflect changes to our website, our services or the law. The updated Terms will be published on this page with a new “Last updated” date and apply from the moment they are published. Changes do not affect reservations that were confirmed before the change, unless the change is required by law. Please check this page regularly.
17. Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them or with the website are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in it. The courts of British Columbia have exclusive jurisdiction, except that if you are a consumer resident elsewhere you may also have the right to bring proceedings in your place of residence under mandatory local law.
Before starting any formal proceedings, we encourage you to contact us so that we can try to resolve the matter informally and in good faith.
18. General provisions
- Severability – if any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.
- No waiver – if we do not enforce a right under these Terms, this does not mean that we have waived it.
- Entire agreement – these Terms, together with our Privacy Policy, Cookie Policy and any written event confirmation, form the entire agreement between you and us about the use of the website.
- Assignment – we may transfer our rights and obligations under these Terms to another organisation, for example if our business is sold, provided your rights are not reduced.
- Language – these Terms are written in English. Any translation is provided for convenience only.
